Terms of Service
It is important to us that your order and delivery are processed to your satisfaction. We would therefore like to ask you to observe the following information:
- Prices
The prices quoted are gross, including all statutory taxes and duties in EURO. Subject to price errors. With the prices shown here, all previous offers and price lists lose their validity. - General
Offer subject to change, errors and prior sale reserved. All orders can only be considered in the order in which they are received and are only accepted with our written order confirmation. - conclusion of contract
Your order represents an offer to us to conclude a purchase contract. As soon as you place an order in the Weingut Pluschkovits wine web shop, we will send you an e-mail confirming that we have received your order and representing a purchase contract for us. The ordered products are then usually delivered to you by DPD or a forwarding agent. The wine web shop of the Pluschkovits winery does not offer products for sale by minors. - revocation
A right of withdrawal for the consumer according to § 5 e KSchG does not exist for the delivery of beverages, as this is excluded according to § 5f Z 7 KSchG (home delivery). If the service from the Pluschkovits winery does not take place as part of a home delivery, a customer who is a consumer within the meaning of the Consumer Protection Act can withdraw from the contract or his contractual declaration within seven working days (Saturday does not count as a working day) from receipt of the goods resign. It is sufficient if the declaration of withdrawal is sent within the period. In the event of an effective withdrawal, the services received by both parties must be returned step by step. The customer must pay an appropriate fee for the use, including compensation for any associated reduction in the general value of the service. The customer bears the costs of returning the goods.

The current shipping costs can be found in the wine web shop. Wines are usually shipped by DPD or a forwarding agent. If the delivery is not made on time, there is no right to compensation or withdrawal from the contract. The delivery is made from the Pluschkovits winery to the delivery address specified by the customer. If the Pluschkovits Winery is unable to deliver the ordered goods through no fault of its own because the Pluschkovits Winery’s supplier does not fulfill its contractual obligations, the Pluschkovits Winery is entitled to withdraw from the order. In this case, the customer will be informed immediately that the ordered product is not available. The legal rights of the customer remain unaffected. If delivery to the customer is not possible because the respective vintage is sold out, the customer will be informed immediately by e-mail or telephone. If delivery to the customer is not possible because the customer cannot be found at the delivery address he specified when the package is handed over, DPD will leave a parcel label at the delivery address with information as to when the package will be delivered again. This is done in three attempts. After the third attempt, the package will be returned to the Pluschkovits winery. We currently offer deliveries by DPD to Austria, Germany, Belgium and the Netherlands. Other countries on individual request and agreement. - Insurance against damage in transit
Our wines travel by freight forwarder and are insured by us against any transport damage, with the exception of weather-related quality reduction due to the transport route (frost, heat…). Damage settlement is only possible if the damage is noted on the bill of lading by the delivering forwarding agent. - Payment Instructions
The customer can pay the purchase price in advance by bank transfer or PayPal (via PayPal also via credit card*). In addition, we offer payment on account for existing customers and in B2B business. As an existing customer, please send us an informal e-mail to activate “payment on account” after registering in the online shop and tell us the e-mail address used and/or the user name (you will receive the user name with the registration confirmation by e-mail after registration in our online shop).* if you do not have a PayPal account, click on “New Login” on the PayPal login page. Here you also have the option of paying by credit card WITHOUT having to create a PayPal account. However, since a Paypal account offers many advantages, we recommend registering a Paypal account. - retention of title
The delivered goods remain the property of the Pluschkovits Winery until full payment has been made. Unless otherwise stated below, further claims of the customer – regardless of the legal grounds – are excluded. The Pluschkovits winery is therefore not liable for damage that has not occurred to the delivery item itself; in particular, Weingut Pluschkovits is not liable for lost profits or other financial losses suffered by the customer. Insofar as the liability of the Pluschkovits winery is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents. If the Pluschkovits winery negligently violates an essential contractual obligation, the obligation to compensate for property damage is limited to the damage that typically occurs. If the goods complained about are returned to the Pluschkovits winery, the Pluschkovits winery will immediately send the replacement goods as supplementary performance. The limitation period for wines (cork defects) is five years, calculated from the time of delivery. - late payment
In the event of a delay in payment, we will charge bank default interest as well as any collection fees or legal fees from the due date. - Collection, processing and use of personal information from our customers
Information we receive from you helps us to facilitate your shopping in the wine web shop of the Pluschkovits Winery. We use the information for the processing of orders and the delivery of the goods as well as for processing the payment. We also use your information to improve our service and our Internet platform, to prevent or detect misuse of our website. We always treat information about the personal data of the customer or the person making the request with the utmost discretion and do not pass it on to third parties. Orders can only be sent if the terms and conditions are accepted. By accepting the terms and conditions, the customer confirms that they are of legal age. See youth protection notice for more information.
